ACLU-NorCal authors report finding CRCR staff "tagging" immigrants, refugees & others in custody for potential ICE deportation

This weekend, CA state Democractic Party Delegates gathered in Sacramento to talk about the next year of their party work. ICE Out of CA activists, including ICE detention survivors, were there to remind the delegates that Governor Gavin Newsom refused to sign the HOME Act (AB 1306) into law this past October, legislation that would have stopped California Department of Corrections and Rehabilitation collusion with ICE (Immigration and Customs Enforcement).


In August, the American Civil Liberties Union of Northern California published a report which said staff at the California Department of Corrections and Rehabilitation were “tagging” immigrants, refugees, and others in custody for possible deportation by ICE. ACLU accused the department of discrimination. The bill Newsom vetoed would have restricted corrections officials from transferring to ICE immigrants who had served their sentence and been granted parole or compassionate release. The governor said it would impede the state’s ability to communicate with federal agencies that assess public safety risks.


Assemblymember Wendy Carrillo  (D52 - Los Angeles) who authored the bill, has vowed to keep trying. “Governor Newsom acknowledged the need to improve the process CDCR currently follows in communicating with ICE regarding the release of justice-impacted immigrants granted parole,” she said in a statement, “but he did not put an end to the dual system of justice that currently subjects them to unequal treatment, a practice I am committed to ending through legislation.”
