Bill would call for judicial review of LWOP sentences prior to June 5th 1990

Senate Bill 94 (Cortese D-15) is moving through the California Assembly and we need your help!


Our next stop will be the Assembly Public Safety Committee on Tuesday June 27th. We hope we can call on our supporters an advocates to again rise to the occasion and submit a letter of support, either as an individual or on behalf of your organization.


SB94 would allow judges to review life without parole (LWOP) sentences for persons who have been incarcerated for at least 25 years and were sentenced for offenses with a “special circumstance” before June 5, 1990, the date of a ballot measure that prospectively tied judge’s hands.


SB 94 allows courts to consider old cases in light of changes in the law since the 1970s and 1980s, thereby applying the law more fairly. This bill does not guarantee resentencing or release. Any individual who is granted resentencing by a judge will then need to go before the parole board, who will make a determination about their suitability for release.
